Section 19(1) of the Freedom of Information Act 2000 states that it is the duty of every public authority:-
- To adopt and maintain a scheme which relates to the publication of information by the authority and is approved by the Information Commissioner
- To publish information in accordance with its publication scheme
- From time to time review its publication scheme
Section 19(2) of the Act states that a publication scheme must:
- Specify classes of information which the public authority publishes or intends to publish
- Specify the manner in which information of each class is, or is intended to be published and
- Specify whether the material is, or is intended to be, available to the public free of charge or on payment
Exemptions under the Freedom of Information Act 2000
Examples include information:
- Containing personal data (this information is covered by the Data Protection Act of 1998)
- Intended for future publication
- That would be prejudicial to international or UK relations
- That would be prejudicial to UK economic or financial interests
- That would be prejudicial to law enforcement
- Held in court records
- Under legal professional privilege
- In relation to criminal investigation or proceedings
- Information that would be prejudicial to commercial interests of a person or Public Authority
